Federal law makes it illegal for employers to discriminate against employees in the workplace. Passed by the United States Congress, the Civil Rights Act of 1964 contains several sections, one of which is called Title VII. Under Title VII, employers cannot discriminate against workers because of race, gender, national origin, and religion, among other factors. Subsequent civil rights legislation addressed discrimination against members of the LGBTQ+ community.
If you face discrimination in the workplace because of your sexual identity, you have the right to seek legal remedies that include monetary damages. An employment attorney can help guide you through the legal process.
As with race and gender, sexual orientation is a protected class under federal law, as well as a vast majority of state laws. Your employer cannot fire you because of your sexual orientation, nor can your employer single you out for disciplinary action because of how you identify sexually. If you deserved a promotion, but your employer passed on you because of sexual orientation, you might have a strong enough case to file a discrimination lawsuit.
Another example that impacts every worker that faces discrimination in the workplace concerns compensation. You have the right to earn the same pay as another employee who has the same level of seniority, a similar record of professional achievement, and the education to warrant a raise. One of the lesser-known examples of workplace discrimination against members of the LGBTQ+ community involves performance reviews. You do not have to accept a lower ranking or a worse review because of your sexual orientation.
The first step for filing a workplace discrimination claim is to discuss your concerns with a human resources manager. An HR manager acts as an intermediary to address your claim of discrimination based on sexual orientation. If the HR manager fails to act, then you file a claim. with the Equal Employment Opportunity Commission (EEOC).
First, you submit an online inquiry, and then a representative from the EEOC interviews you to get your side of the story. After the interview, you complete a Charge of Discrimination that you submit through the EEOC Public Portal. If you have fewer than 60 days to file a Charge of Discrimination, the EEOC provides directions on how to file your charge quickly. This usually involves visiting the nearest EEOC office. In Florida, you can file a claim with the Florida Commission on Human Relations. The MDCR will then investigate your claim and determine the next course of action. They may determine you are owed compensation or suggest you file a civil lawsuit. The FCHR and the EEOC have “work-sharing agreement,” in which the agencies cooperate with each other to process claims.
After a thorough investigation, the EEOC and/or your state local agency might rule in your favor. This means your employer can address the issue by giving you a raise, promoting you to the next open position, and/or improving your employee performance review.
